Peterson Baker, PLLC is a boutique Nevada commercial litigation firm.  Founded in 2016 by two female attorneys, the Firm brings energy, strategy and a collective 50 years of litigation experience to an increasingly complex legal environment.  The Firm’s laser focus on trial and appellate work encompasses business torts, contract disputes, gaming disputes, legal malpractice defense, intellectual property disputes, and real estate litigation.  The Firm prides itself on its industry knowledge, hard work, and legal acumen, and strives to provide legal expertise and unique solutions tailored to each client’s need.

    • Representing one of the Republic of Argentina’s largest creditors—with judgments totaling $1.7 billion—in post-judgment discovery and enforcements proceedings.
    • Matters regarding wrongful foreclosure action where plaintiff sought to set aside the homeowners’ association’s non-judicial foreclosure sale upon 114 parcels of real property and sought over $48 million in damages.
    • Represented health insurers and Medicare Advantage organizations in emergency TRO and preliminary injunction motions involving contract disputes and noncompetition issues with providers.
    • Numerous matters related to breach of commercial leases.
    • Disputes involving failed insurance companies and breach of fiduciary duty claims against the board of directors.
    • Lawsuits involving a homeowners’ association, developer, and homeowners regarding changing the homeowners’ views of a golf course.
    • Successfully prevented an injunction from being entered against a sports and entertainment company, which would have prevented their attendance at a world-renowned trade show.
    • Representation of The University of Nevada in connection with litigation filed by the Western Athletic Conference in response to the University’s efforts to move its athletic programs into the Mountain West Conference.
    • Prevented class certification and successfully defended a large commercial client against allegations that it violated a deceptive trade practices act.
    • Assisted in the successful defense of major gaming manufacturer in the alleged violation of an option agreement seeking damages in excess of $14 million.
    • Breach of contract dispute regarding automated people movers.
    • Numerous disputes regarding partnership agreements, including defending partner against allegations of fraud by co-partner in limited partnership.
    • Represented creditor in $50 million dispute over development and mezzanine loan agreements and subordination of related lease agreements at hotel/casino.
    • Defended national real estate brokerage firm in contract dispute over commissions allegedly owed to seller’s broker.
    • Defended national commercial brokerage firm in connection with alleged violations of NRS 645.
    • Represented commercial brokerage firm in efforts to collect more than $1 million in wrongfully withheld commissions on sale of hotel/casino property.
    • Represented corporation in responding to allegations of deceptive trade practices by the Nevada Attorney General’s Office.
    • Defended former board members of failed corporation against allegations of breach of fiduciary duty with potential damages of $70 million.
    • Represented tenant in dispute with landlord involving wrongful eviction and collection of rents
    • Lawsuits regarding the enforceability of inter-credit agreement between the junior lender and senior lender.
    • Disputes over the termination of a contract to acquire an island in the Bahamas
    • Breach of contract dispute over the installation and operation of laundry equipment at an apartment complex.
    • Matters involving a breach of development and loan agreement.
    • Lawsuits regarding false and misleading information in an insurance application
    • Disputes regarding claims for federal antitrust violations and deceptive trade practices.

    • Numerous lawsuits regarding airspace takings claims against an airport.

    • Lawsuits involving claims of defective design and manufacture of exercise equipment.
    • Dispute concerning proposed class action alleging that common use self-service kiosks at airport discriminate against the blind.
    • Lawsuit involving wrongful death action related to the design of the Southern Las Vegas Beltway.
    • Action involving claims for misappropriation of name and likeness, unauthorized commercial use of name and likeness, unreasonable publicity to private facts, and unreasonable intrusion upon seclusion of another based on the use of individual’s photographs in an advertisement.
    • Several lawsuits arising from slip and falls in casinos.
    • Dispute over violations of the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.
    • Lawsuits regarding claims involving violations of 42 U.S.C. § 1983.
  • Construction
    • Worked on highly complex construction litigation claims involving the construction of a courthouse and jail on behalf of a local governmental entity. Claims for both projects involved construction defect allegations against the general contractor, defective design and specification allegations against both architects, and breach of contract allegations against a billion dollar global construction management company.
    • Several matters regarding defects in commercial buildings.

    • Matters regarding trademark infringement and unfair competition under federal statutes, with pendent state and common law claims for trademark infringement and dilution.
